Overview

Three premier institutions join forces to present the top energy arbitration program of 2016. The Institute for Transnational Arbitration, the Institute for Energy Law, and the International Court of Arbitration of the International Chamber of Commerce invite you to a 1½ -day program designed to meet the needs of arbitrators, in-house counsel, law firm practitioners, and independent dispute resolution professionals active or interested in energy matters.

The program will address the essential current influences on arbitration in the energy sector today with speakers whose insights on those influences assure that every minute of this program is focused on the present and future of disputes of immediate concern to attendees and their clients. The stage will be set with a keynote presentation by Chuck Davidson, Venture Partner of Quantum Energy Partners and former Chairman and CEO of Noble Energy. The conference luncheon will feature an oral history interview with one of the true leaders in the modern evolution of international arbitration, Gerald Aksen.

Showcase panels featuring in-house expertise and advisors representing the top legal minds in the sector will address issues ranging from the impact of failing states on investor-state disputes, emergency arbitrators, the paradigm shift of the proceedings surrounding the Yukos cases, the composition of tomorrow’s arbitral leaders, cybersecurity and data privacy, ethics in party representation and a head-on engagement with problems in recent damages assessments. Larry Shore of Herbert Smith Freehills will provide the annual review of significant developments, assuring a comprehensive update for attendees.

At the conclusion of the conference, a discussion forum moderated by world-recognized expert Mark Baker will draw together all threads and assure that attendees have their questions answered as well as share their own experiences.

Ethics and the IBA Guidelines on Party Representation

In today’s increasingly globalized legal market, attorneys from different corners of the world often have different interpretations of attorney conflict principles. The IBA recently revised its Guidelines on Party Representation in an attempt to remove uncertainty and standardize party representation rules in international arbitration. This session addresses questions including: What conflict issues may arise in the practice of international arbitration? How have practitioners responded to the IBA Guidelines since their adoption? Have they been a game-changer or a non-event? Have parties and attorneys been implementing their suggestions?

Navigating the Changing Geopolitical Landscape During an Energy Dispute - Balancing the Political and Arbitral Developments in Regard to Iran, Iraq, Russia, Libya, Syria and ISDS Issues with Failed or Failing States

This panel will address the geopolitical issues surrounding energy disputes in Iran, Iraq, Russia, Syria and Libya, and their implications for international arbitration. Are Iraq, Syria, and Libya failed states? If so, with whom does one negotiate? Do these states have BITs that can be accessed today? Is international arbitration a valid forum for resolving these disputes? The panel will address concrete problems and real examples. What are the implications for international arbitration of the sanctions regimes involving Iran and Russia? Is the situation progressing or regressing? The panel will discuss instances of political sanctions in international arbitration, including the Libyan Sun Oil case from the 1980s.

Beyond the hyperbole, what do the Yukos Awards bring to the investment arbitration field? Is it a sui generis case decided on its (highly unusual) facts, or one that takes the treatment of the Energy Charter Treaty and the treatment of damages in a new direction? How politicized, if at all, may we consider the Tribunal’s decisions? Does it matter, as is being alleged in the challenge pending before the Dutch Courts, that the Tribunal Secretary drafted the Award, rather than the Tribunal itself?
